Abstract

This paper addresses one of the application principles of Labour Law, that is, the principle concerning the more beneficial condition of the contract. In particular, this study focuses on the analysis of a particular case that has been subject of jurisprudential debate, namely, the concession of the Christmas basket from the company to the workers, with the purpose of solving whether this gift constitutes a more beneficial condition or a corporate generosity act.
