Mecanismos jurídicos de protección internacional frente a la violencia sexual en los conflictos armados

Abstract

The magnitude and severity of wartime sexual violence throughout history have not been accompanied by adequate international legal regulation, and its legal prohibition and prosecution have been inefficient and relatively recent. In this text, on the one hand, we review the historical evolution of this international legal regulation; on the other hand, we examine some of the major developments in the jurisprudence of the international criminal tribunals (notably the International Criminal Tribunal for the Former Yugoslavia, the International Criminal Tribunal for Rwanda and the International Criminal Court). Finally, we make a brief assessment of the progress made, to highlight some of the limitations and opportunities that currently exist.
