Resumen

Directive 2012/29/EU of the European Parliament and of the Council of the European Union (EU) of 25 October 2012 establishing minimum standards on the rights, support and protection of victims of crime and replacing Council Framework Decision 2001/220/JHA was a milestone in the formal recognition of a set of procedural and extraprocedural rights for victims of crime. However, some experts described it as an empty promise because it did not foresee the necessary means, both material and personal, as well as the necessary change in legal professional cultures. Faced with the fact of its non-compliance in many countries, in June 2020, the Commission adopted the EU Strategy on Victims’ Rights (2020-2025) to ensure access to justice for all victims, regardless of the place of the commission of the crime in the EU or the circumstances in which the crime was committed. The Strategy set out a number of non-legislative measures in relation to victims’ rights, including the review of the Directive, and provided for the Commission to assess its impact and to submit a legislative proposal to update it. The Commission presented its proposal in July 2023. This descriptive article analyzes its implications from a general comparative perspective.
