Abstract

The present paper aims at analysing the most recently criminalised crime in the ICC Statute: the crime of aggression. The States Parties to the ICC did not reach a consensus on its definition, nor on the conditions for the exercise of the Court's jurisdiction, until the Kampala Review Conference in 2010, and the Court's jurisdiction was not activated until 2018. The difficulties in agreeing on a definition and on the conditions for the exercise of jurisdiction are largely due to the fact that it is a particularly sensitive issue for States, insofar as the crime of aggression must arise from an "act of aggression" committed by a State. In the following lines, in addition to the elements of the act and the crime of aggression, the conditions for the exercise of the ICC's jurisdiction over the aforementioned crime will be studied. Such conditions depart from the general regime established for the other three crimes within the jurisdiction of the Court and limit –even more– the possibility for the ICC to exercise its jurisdiction.
