Abstract
This paper analyses a judgment in which the Court of Justice of the European Union rules on a preliminary ruling raised by the Supreme Administrative Court of Austria. Faced with a situation in which a religious association established in a Member State recognizes a college in another Member State as a confessional college and requests public funding in the latter, it is questioned whether the principle of organizational autonomy of religious communities included in art. 17.1º TFUE is contrary to the application of the freedom of establishment.
