Abstract
This paper analyses the role of the rules of law applicable to non-contractual civil liability arising from human rights abuses committed by companies in the development of their cross-border activities during the process of drafting the future European Due Diligence Directive. The Rome II Regulation on the law applicable to non-contractual obligations and the potential suitability of its operation to this type of situation will be studied. This will allow us to underline the importance of advancing, together with material unification, in the unification of private international law instruments in order to guarantee victims access to judicial redress mechanisms and to consolidate greater protection of human rights at a global level.
