Abstract

The purpose of this doctoral thesis is to analyze labour liabilities in group of companies and their labour legal basis in the Spanish law. From a legal and dogmatic analysis and incorporating some aspects of the law and economics approach, the objective is to assess if the current Spanish case law model used to identify and ascribe labour liabilities in a group of companies is effective, efficacious and responds to an efficiency criterion. The final aim is to determine if such a case law system is appropriate for employees’ protection in Spain and, if not, to propose a conceptual matrix and legal basis that are more appropriate for this purpose and, in any case, to make de lege data and de lege ferenda proposals to provide greater legal certainty to all legal operators in this issue.
