Abstract

The analyzed ruling, with obvious practical consequences in regard to the regime of guarantees required from the subjects that participate in customs traffic, determines the scope of the responsibility of the indirect representative in the light of article 77.3 of the Customs Code and limits it to the customs duties accrued by the merchandise that has been declared, excluding the one that eventually affects VAT on imports that corresponds to them. Likewise, it specifies that the joint and several liability of the indirect customs representative with the importer, as a debtor for the payment of VAT on imports, can only be maintained when the national provisions recognize it explicitly, unequivocally and without question
