Abstract
The present work deals with the debate about whether is acceptable in our legal system the recharge of mortgage, given the unclear drafting of legislation in this area. In order to offer a solution to it, reference is made to the interpretation that the legal doctrine and the DGRN make article 4.3 of law 41/2007, highlighting the change in interpretation that it makes the DGRN, in favor of its admission, in its recent resolution of 14 may 2015, as an effective instrument for easing in the mortgage market.
