Abstract
Throughout the expansion of the SARS-CoV-2 pandemic, public health has been considered without discussion as the legal asset to be protected against the virus. Nothing can be disputed against this position, which has been generally accepted, and in particular by health professionals, health authorities and lawyers. In other words, a legal asset of a collective and therefore supra-individual nature. However, the enormous global expansion experienced by Covid-19, with several million people infected, has led to the idea that public health may fall short as a protected legal good. The author reflects on this relevant question throughout this work.
