Abstract

In the judgment of 15 November 2016, the European Union Court (Grand Chamber) states that the limit of age of 35 years for the access to the Basic Scale as police officers of the Autonomous Community of Basque Country (Ertzaintza) can be justified in attention to the structural criteria. Since the objective is to maintain the operational capacity and proper functioning of the police service, that objective requires that the possession of particular physical capacities should be envisaged not statically, but taking into consideration the years of service that can be accomplished by a police officer after he or she has been recruited
