Résumé
This paper examines the criminal law implications of planned obsolescence. Specifically, it aims to answer the question of whether the criminal law should intervene or not, considering two limiting principles of the criminal law: the principle of exclusive protection of legal assets and the principle of minimum intervention. The paper concludes that it is not necessary to incorporate an autonomous offence of planned obsolescence. There are other offences, at least, in the Spanish Criminal Code, such as false advertising, fraud and property damages that can respond to the most serious cases.
