Resum
The Court of Justice, in its judgment of 14 March 2024 in the Commission v United Kingdom (Arrêt de la Cour suprême) case , has ruled that the judgment of the Supreme Court of the United Kingdom, by ordering the enforcement of the Micula arbitral award, has infringed several provisions of the EU law, in relation to Article 127(1) of the Agreement on the Withdrawal of the United Kingdom from the European Union. The Court of Justice, in a decision which will be relevant to future applications for enforcement of ICSID awards relating to intra‐EU relations which may be brought before national courts of the Member States, has concentrated its efforts on disabling the legal formula which, on the application of Article 351(1) TFEU, had allowed the British court to accept the enforcement of the award, leaving aside compliance with the obligations arising from EU law.
