Zusammenfassung
This paper provides a critical analysis of the jurisprudence contained in the Basque Country’s High Court of Justice’s judgment of 17 November 2022 (ECLI:ES:TSJPV:2022:2805), which has found that overriding a forced heir (“preterición”) is a legal institution which, whilst directly related to the system of force shares, affects the requirements for a valid will and for the appointment of an heir, which is why, should there be a conflict, its regime shall be determined by the law applicable at the time the will was made and not, therefore, by the law applicable at the time the deceased died.
