Presencia militar y jurisdicción extraterritorialla dilución del concepto de “control efectivo sobre el territorio” en los casos de Nagorno-Karabakh ante el TEDH

Résumé

The extraterritorial application of the ECHR is taking a prominent place in the jurisprudence of the European Court of Human Rights given the growing tendency of the States parties to act beyond their borders. The Court has recently addressed the examination of claims regarding the conflict in the Azerbaijani region of Nagorno-Karabakh. The main judgment, Chiragov an others v. Armenia, is of particular interest due to the interpretation of the concept of "effective control over territory" developed by the Court in order to declare the jurisdiction of Armenia over the region. The criterion of "military presence" as the main indicator of the exercise of control over the territory has been displaced by weaker and more vague factors such as the "military, economic and political cooperation" with the subordinate local administration. It is foreseeable that this judgment will have a great impact, not only on the more than a thousand cases pending on the conflict in this region, but also on the Court’s jurisprudence on extraterritorial jurisdiction.
