Résumé

The European Commission has taken the decision to launch an in-depth investigation to assess the compatibility of the Antin award with the state aid regime of the European Union. The Commission doubts that the enforcement of the award — as State aid — can be authorized, considering, firstly, that it may violate the EU Treaties; In this sense, the judgment of the Court of Justice in the Republic of Moldova / Komstroy case, issued on September 2, 2021, will be decisive in this evaluation, since it has declared that the intra-EU investment arbitration of the Energy Charter Treaty is incompatible with EU Law. Second, the Commission doubts whether the State aid (the award) can be compatible with the Guidelines on State aid for environmental protection and energy. This investigation procedure is of undoubted interest for Spain insofar as, beyond the Antin case, its consequences will have a direct impact in the numerous arbitration cases on "renewables" still pending resolution.
