Abstract

This study makes some proposals for improving the current legal norm, that affect both legislative technique and content. A partially organic Act is proposed in order to include related matters that are closely connected with the subject and with the means of articulating the exercise of the fundamental right. It would make possible to offer a text as complete as possible, identified in the Act itself as non-organic. The difficulty of opting for this proposal cannot be hidden, due to the transversality of this right and the distribution of competences at different levels of government in some of the matters in which the exercise of this right is projected. Some of the subjects that are absent in the current legal norm should be included such as behavior in accordance with conscience and the right to conscientious objection, and others that should be reviewed, such as the freedom of conscience of minors which should be graduate according to their maturity.
